Who can file a Motion to Quash?

The recipient of the subpoena (most common — even if you are not a party to the lawsuit), OR a party to the case with a personal interest in the documents (privacy, privilege). Both have standing under FRCP 45(d)(3) (recipients) and FRCP 26(c) (parties seeking protective orders).

What are the strongest grounds?

Specificity. "Overbreadth" alone is weak; "the subpoena requests every email I sent over 5 years when the case is about a 2024 transaction" is strong. The strongest motions combine 2-3 grounds with specific factual support and citations to applicable rules. Privilege grounds (attorney-client, work-product, physician-patient, spousal) are usually granted if the privilege is genuinely applicable.

Before the compliance date stated on the subpoena. Most courts deem objections waived if not raised in time. A safe rule: file at least 7 days before compliance is due. If the compliance date is imminent (e.g., 3 days away), you can file an emergency motion to quash and a separate motion to extend the compliance date.

What happens if the court denies my motion?

You must comply by the compliance date (or whatever extended date the court sets). Non-compliance after a denied motion can result in contempt of court — fines, attorney fees against you, and in extreme cases incarceration. Don't treat the motion as a delay tactic; treat it as a one-shot challenge.

Can I file just to delay the case?

Don't. Federal Rule 45(d)(1) and state analogs allow the court to award attorney fees against the party serving an overbroad subpoena, but they ALSO allow fees against a party who files a frivolous motion to quash. Bring the motion only when you have a real basis. A frivolous motion costs you legal fees on top of having to comply anyway.
