Why subpoena the original creditor?

When you're sued by a debt buyer (Midland, Portfolio Recovery, LVNV, etc.), the buyer rarely has the original signed credit agreement, account-opening identity records, or detailed account history. The original creditor (Citi, Capital One, Synchrony, etc.) DOES have those records — but the debt buyer usually didn't ask for them or didn't get them in the bulk-debt purchase. A subpoena duces tecum to the original creditor flushes out (a) the documents that prove your case, OR (b) the original creditor's response that 'we no longer have these records,' which is itself ammo for MSJ on standing.

Can I as a pro-se issue a subpoena?

Not directly. FRCP 45(a)(3) authorizes the COURT CLERK to issue subpoenas on the requesting party's behalf, OR an attorney as officer of the court. Pro-se litigants must take the prepared subpoena to the clerk's office to have it signed and sealed. State rules vary but most are similar. The wizard generates the document; the clerk issues it.

Federal: FRCP 45(b)(1) requires personal service by a non-party adult — you can't serve it yourself. Hire a process server (~$50-$150) or ask a friend over 18 who isn't a party. State varies — many states allow certified mail with return receipt for document subpoenas. Check your jurisdiction's specific subpoena-service rule.

What if recipient objects?

FRCP 45(d)(2)(B) gives recipient 14 days from service to serve a written objection (or until production date if sooner). Common objections: undue burden (very specific factual showing required), proprietary information, privacy. Once an objection is served, you cannot inspect the materials without a court order. File a motion to compel under FRCP 45(d)(2)(B)(i). Recipient who simply ignores the subpoena can be held in contempt under FRCP 45(g).

Do I have to pay the recipient?

FRCP 45(d)(1) requires the issuing party to take reasonable steps to avoid imposing undue burden or expense on a person subject to the subpoena. For deposition / hearing subpoenas, the witness fee + mileage must be tendered with service ($40/day under 28 U.S.C. § 1821). For document-only subpoenas, no fee is required up front but the recipient may invoice for reasonable copying / production costs and you must reimburse.

After your discovery bundle has been served on plaintiff and either (a) plaintiff has admitted no original-creditor records or (b) plaintiff has produced incomplete records and you need the originals. Subpoena timing matters — most courts require subpoenas to allow at least 30 days for production, and you need responses in time to use them at MSJ or trial.
