What is the deadline?

Short and STRICT — and varies by jurisdiction. Federal civil cases: 30 days from entry of judgment under FRAP 4(a)(1)(A); 60 days if the United States is a party. Utah: 30 days under URAP 4(a). California: 60 days from notice of entry under Cal. R. Ct. 8.104. Most other states: 30 days. Miss it and the appeal is lost forever — the appellate court has no jurisdiction over a late-filed appeal.

Counterintuitive but firm: the Notice of Appeal is filed with the TRIAL COURT clerk (not the appellate court). The trial court clerk then transmits the record to the appellate court. Filing in the wrong court is one of the most common pro-se mistakes — and the deadline keeps running while you figure it out.

Generally only FINAL judgments. Interlocutory orders (orders entered before final judgment that don't fully dispose of the case) typically can't be appealed yet — exceptions exist (28 U.S.C. § 1292(b) discretionary federal interlocutory; collateral-order doctrine; injunction orders). If you're unsure whether the order is final, file the Notice of Appeal anyway within the deadline — better to file and have the appellate court dismiss for lack of jurisdiction than to miss the window on a final order.

Do I need to pay a fee?

Yes — federal appellate filing fee is $605 (2024). State varies. If you can't afford it, file an in forma pauperis application: federal Form AO 240 (the same one used at trial, or AO 240A for prisoner appeals). Most state courts have similar poverty affidavit forms. IFP at trial court does NOT automatically continue on appeal — you must re-apply.

What happens after I file?

Most courts require a docketing statement within 14-21 days. Then the appellant's opening brief — typically due 40-90 days after the record is filed. Then the appellee's response brief, then your reply, then (sometimes) oral argument, then the decision. Federal civil appeals take 6-18 months on average; state intermediate appellate courts vary.

Most pro-se appeals lose. Appellate review is deferential to the trial court — abuse-of-discretion or clear-error review for most issues. Reversal usually requires either (a) a clear legal error the trial court made on a question of law, or (b) findings of fact unsupported by evidence. Before filing, read the trial court's order carefully and identify the SPECIFIC legal error you'll argue. 'I disagree with the result' is not an appellate argument.
