When should I demand a Bill of Particulars?

Early — typically with or shortly after your Answer. The Demand can ALSO be served before answering in some jurisdictions (NY allows pre-answer demands). The earlier the Demand, the longer plaintiff has to scramble for documentation that often doesn't exist. Most successful pro-se debt-defenses include this as one of the first three documents served.

How is this different from interrogatories?

Bill of Particulars is a state-court device that AMPLIFIES the pleading itself — once served, the plaintiff is bound by the Bill at trial. Interrogatories are discovery tools that gather information but don't bind the pleadings. NY uses both; California's CCP largely replaced the Bill with interrogatories EXCEPT for common-counts complaints (book account / open account), where the Bill is still required and is more powerful than interrogatories. Most debt-buyer complaints plead common counts — making CCP § 454 the controlling statute.

What happens if plaintiff doesn't respond?

Two consequences. (1) Preclusion: in NY under CPLR § 3042(c), failure to serve a Bill in response to a proper demand can preclude plaintiff from offering evidence on the omitted particulars at trial. In California under CCP § 454, failure to provide an account stated bars the plaintiff from any common-counts recovery. (2) Motion to Compel: file under the state's discovery / case-management rule. Will plaintiff comply?

Often not — and that's the point. Junk-debt buyers don't have the records, original creditors don't want to dig them out for an account that's been sold. A plaintiff who can't supply the particulars is admitting (de facto) that it can't prove the case. Use the absence as MSJ ammunition.

Does this work in federal court?

No. Federal court replaced the bill of particulars in 1948 (FRCP amendments). FRCP 12(e) Motion for More Definite Statement is the federal analog — narrower in scope, only granted when the pleading is so vague the defendant cannot frame a response. How specific should the particulars be?

Very. Generic 'state the basis of the claim' is too vague — courts deny vague demands.
